Where a Syracuse DWI actually goes

Which courtroom you end up in is decided by where the officer was standing, not where you live or where you were driving to.

• Inside the city limits — Syracuse City Court, 505 South State Street.
• Outside the city, the town or village justice court for wherever the stop happened. Onondaga County has twenty-six of them, and twelve sit somewhere other than their namesake town. Every one is listed with an address and a phone number on our Onondaga County courts page.
• Felony charges — Onondaga County Court. A second DWI within ten years is a felony, so this is not a rare outcome.

The DA has a bureau for this

Worth knowing before you decide how to handle a charge: the Onondaga County District Attorney operates a dedicated DWI Bureau, prosecutors who handle impaired driving cases and very little else.

You are not facing someone who picked up the file that morning between other matters. They know the testing equipment, the standard field sobriety protocols and the officers, because they see the same ones every week. That is not a reason to despair; it is a reason not to walk in unrepresented assuming the charge will sort itself out.

Why enforcement spikes on certain weekends

Onondaga County runs a STOP-DWI program covering enforcement, prosecution, probation and treatment, funded, as in every New York county, out of the fines. Its office is at 505 South State Street, the same address as the City Court.

In practice it pays for the extra patrols that appear around holiday weekends and large events. It does not decide your case. It does explain why a stretch of road that is quiet in February is worked hard on a Saturday in July, and why so many arrests cluster on a handful of nights a year.

Treatment court, and diversion

Syracuse City Court operates a treatment court. Separately, judicial diversion under CPL article 216 exists as a route where the District Attorney objects to a defendant entering treatment court.

Eligibility for either is specific and neither is automatic. This page does not tell you that your charge qualifies, because that depends on the charge, the record and an assessment. It is one of the first things worth asking about, and it is the kind of option that closes once a plea is entered.

Students

Syracuse University, Le Moyne, SUNY ESF and Upstate Medical put a large student population on the same roads, and a DWI arrest reaches further for them than for most people: student conduct proceedings, scholarship conditions, professional licensing later on, and for international students, immigration consequences.

Those processes run on their own timetable, independently of the court. If you are enrolled anywhere, say so on the first call.

The charges themselves

The charge levels, the mandatory fines, the revocation periods, Leandra’s Law and what a chemical test refusal costs are set out in full on our DWI and DWAI page, including the single most useful distinction in this area, that DWAI by alcohol is a traffic infraction and DWI is a misdemeanor.

The one thing to carry over here: the DMV case is separate. A chemical test refusal is dealt with by the DMV at its own hearing, on its own schedule, and it can revoke your license for at least a year whatever happens in Syracuse City Court. Winning the criminal case does not undo it.

My license is from another state. What happens to it?

New York can suspend or revoke your privilege to drive here and reports the conviction to your licensing state, which then applies its own law. You will generally need to appear in the New York court, unlike an ordinary traffic ticket.

How fast do I need to act?

Quickly, because two clocks start at once. The criminal case runs through the court, and the DMV runs a separate proceeding on a chemical test refusal that can revoke your license for a year regardless of what the court does. The refusal hearing has its own short deadline.
