Privacy policy

This describes what this website collects and what happens to it. It covers the website only. Information you give us once we are acting for you is governed by the rules on client confidentiality, which are stricter than anything on this page.

The short version

  • The only information we collect from you is what you type into the contact form, plus the ordinary server records every website keeps.
  • We do not sell it, rent it, or share it for advertising. There are no advertising trackers on this site.
  • Sending the form does not make us your lawyers, and what you send before we agree to act is not protected the way a conversation with your attorney is.
  • You can ask us to delete what you sent. Contact details are at the bottom.

What we collect

What you type into the contact form

Your name, email address, phone number, the type of matter, the court if you name one, and your message. The form also records which page you sent it from, so we know what you were reading when you decided to get in touch, and it carries a hidden field used only to catch automated spam.

All of it is optional in the sense that nobody has to use the form. You can call either office instead, and a phone call leaves no record on this website at all.

Ordinary server records

This site is hosted by Netlify, which keeps the usual web server logs: IP address, browser and device type, the pages requested and the time. That happens for every visitor to every website and we do not use those logs to build a profile of anyone.

What we deliberately do not collect

No advertising or social media pixels. No session recording or heatmaps. No chat widget. No newsletter list. We do not buy information about visitors from anyone else, and we do not sell or rent what we hold.

The three pages carrying a map are our offices page and the two office pages for Cicero and Cortland. Every other page on this site loads nothing from a third party. The typefaces are served from our own site rather than from Google Fonts, which most websites do not do.

Cookies

This site sets no cookies of its own. Google Analytics sets first-party cookies to tell a returning visit from a new one, and the embedded maps may set Google's cookies on the three pages that carry one.

Your browser can block or delete all of it. Most browsers also send a Do Not Track or Global Privacy Control signal, and analytics can be blocked outright with any standard content blocker. Nothing on this site stops working if you do.

What we use it for

  • To answer you. That is the whole purpose of the form.
  • To run a conflicts check. Before we can act we have to confirm the other side is not already a client of ours.
  • To see which pages are useful, in aggregate, so the site can be improved.
  • To keep the site working and to deal with spam and abuse.

We do not use it for anything else, and we do not make automated decisions about anybody.

Two things worth knowing before you send the form

Sending it does not create an attorney-client relationship. Nothing does until we have agreed to act for you and said so. Until then we are not your lawyers.

Keep the first message brief. Because we have to run a conflicts check before taking a matter on, and because the protection that covers a conversation with your own attorney is not yet in place, the first message is better as what kind of problem, when, and where than as the full account. There is time for the rest once we have confirmed we can act. There is more about this on our contact page.

How long we keep it

Form submissions are kept while we deal with your inquiry and for a reasonable period afterwards, because a conflicts check needs to know who has approached the firm before. If we take your matter on, the file is kept for as long as the rules governing client files require, which is longer and is a separate question from this website.

Server logs and analytics data age out on the ordinary retention schedules of the services above.

How it is protected

The site is served over HTTPS on every page, so what you type into the form is encrypted in transit. Access to submissions is limited to people at the firm who need it.

New York's SHIELD Act (General Business Law §§ 899-aa and 899-bb) requires businesses holding New York residents' private information to keep reasonable administrative, technical and physical safeguards appropriate to their size. We take that obligation seriously. No system is perfect, and anyone who tells you otherwise is selling something.

Children

This site is meant for adults and we do not knowingly collect information from anyone under 13. If you believe a child has sent us something through this site, call us and we will delete it.

Asking us to delete what you sent

Call either office or email contactus@cdlfpllc.com and ask. If we are not acting for you and there is no reason we have to keep it, we will delete it. If we are acting for you, the file is governed by the rules on client files rather than by this policy, and we will explain what those allow.

Changes

If this policy changes, the date at the top changes with it. There is no archive of previous versions, so if the current wording matters to you it is worth keeping a copy.
